Australian residents are taking their Actos fight to the U.S., joining the growing number of plaintiffs seeking compensation from Takeda Pharmaceuticals. According to recent reports, Australian doctors and patients were kept in the dark about the dangers of Actos use even as other nations were removing the drug from their pharmacy shelves. Now, some Australian Actos lawyers and users are hoping that a U.S. class action lawsuit can help them where their own courts have proven inefficient.

There are currently more than 3,000 Actos bladder cancer lawsuits pending in the United States, with the first case having recently been decided in favor of the plaintiff. The cases are divided between multi-district litigation (MDL), multi-county litigation (MCL) and class action lawsuits. The Australian plaintiffs qualify for a class action lawsuit here in the U.S.

One such plaintiff is 69-year-old Peter Marshall, an Australian resident who recently filed a claim in the U.S. Marshall alleges that he was diagnosed with bladder cancer after taking Actos to treat his diabetes. Marshall says that he was shocked by the diagnosis, due to the complete lack of warnings available to Australians. He is seeking unspecified damages.

Marshall is just one of a growing number of Australians seeking justice here in the U.S. Research has shown a definitive link between bladder cancer and Actos, which has been acknowledged by the U.S. Food and Drug Administration and other international health organizations. Evidence indicates that the manufacturer, Takeda Pharmaceuticals, may have knowingly concealed the cancer risk from the public for years. Most plaintiffs agree that had they known the risk of contracting cancer, they never would have taken Actos in the first place.
